General terms and conditions for the online Reservation service

 

IMPORTANT NOTICES:

The following general terms and conditions were originally redacted in Italian and were later translated in English. They are only provided in this additional language for ease of use of the Customer. Regardless of the language they’re translated to, only the Italian version has legal validity in the Italian Court.

All the following information can be subject to change, it is the Customer’s duty to contact the car park and verify everything is up to date.

Terms and conditions apply to all car parks managed by Interparking Italia unless otherwise stated.

Service conditions and special deals are available at the manned cash office during the office opening hours.

 

1. Object

1.1. The following General Terms and Conditions (hereinafter “General Conditions”) apply to the online Reservation of a parking space inside the car park managed by “New Linate Parking S.r.l.” with registered office in Venice, Isola Nuova del Tronchetto 14, VAT number 04472770272, landline 02-70201021, Certified mail: newlinateparking@legalmail.it (hereinafter “NLP”). The aforementioned reservation can be made through the websites newlinateparking.it and linateparking.it (hereinafter “Website”) and it is regulated by the following conditions (hereinafter “Service”).

1.2. There are two kinds of Reservation available depending on the selected car park: (i) Reservation with payment on site (ii) Reservation with online advance payment.

1.3. The Reservation doesn’t imply the assignment of a specific parking space but guarantees the availability of one free parking space inside the selected car park.

1.4. The parking spaces available for Reservation in the Website are limited in number.

 

2. General provisions

2.1. Before confirming the Reservation, it is the Customer’s responsibility (hereinafter “Customer”) to carefully verify these General Conditions and the selected car park’s Regulation, the latter being available both online and inside the car park (hereinafter “Regulation”), including but not limited to the opening hours and the maximum height of vehicles that can enter the car park. By confirming the Reservation the Customer fully accepts the General Conditions and the car park Regulation.

2.1.1. The Customer acknowledges and accepts that NLP does not offer any custody or surveillance service for the vehicles parked in the parking areas available to the Customer and can not be held responsible in any way in case of theft or direct/indirect damage to the vehicle.

2.2. NLP reserves the right to modify the General Conditions at any given time. The updated version of the General Conditions will always be available on the Website.

 

3. Reservation and contract completion

3.1. To make a Reservation the Customer must follow the instructions on the Website and fill in the required information and data in the dedicated fields (e.g. personal data, contacts, vehicle data, desired time and date of entry and exit from the car park). The Customer takes full responsibility declaring that the provided data is correct, complete and up to date.

3.2. A summary including the main details, total price and duration of the service will be provided to the Customer before the Reservation is confirmed. The customer expressly acknowledges that forwarding a confirmed Reservation implies the payment obligation for the Service to NLP.

3.3. The Reservation request is considered accepted by NLP and the contract between the latter and the Customer completed once the confirmation email is received (hereinafter “Reservation Confirmation”) in the email address provided by the customer, which will include:

(i) The details of the purchased Service

(ii) The Reservation code or QR Code

(iii) The car park access methods and instructions that the customer must correctly follow 

3.3.1. If the Customer does not receive a Reservation Confirmation it is his sole responsibility to contact NLP at the addresses mentioned in article 8.1.

3.4. NLP reserves the right not to accept the Reservation request in the event of:

(i) Lack of availability of parking spaces in the car park selected by the Customer;

(ii) Failed or denied payment;

(iii) Previous Customer’s faults towards NLP.

3.5. The Service purchased by the Customer is strictly personal and not transferable or assignable to third parties. The Sevice is only valid for the date, time, price, license plate and car park indicated in the Reservation Confirmation, exception made for subsequent changes made through the dedicated Website area.

 

4. Fees and payment methods

4.1. The “online” fees of the parking areas are available on the Website (hereinafter “Online Fees”). The Online Fees are subject to change and will be regularly updated on the Website, and in any case stated to the Customer before they confirm the Reservation.

4.2. Reservation with payment on site.

Before leaving he car park the Customer must pay the due amount, calculated based on the Online Fees and duration defined in the Reservation Confirmation, at the automatic cash machines available via credit card, bancomat or cash.

4.3. Reservation with online advance payment

The total amount defined in the Reservation Confirmation must be paid, in Euros, during the Reservation request, by credit card, bancomat or any other online payment accepted method.

4.4. Customers with a Telepass device must cover/block their device while approaching the car park lanes that accept that type of payment method, to prevent additional charges. If the Customer accidentally passes through said lanes to enter the car park, they must call the car park staff via the devices in the car park or directly at the manual cash office to cancel the transaction. To complete the aforementioned procedure the Customer must bring and provide their own Telepass device and a copy of the Reservation Confirmation. If the Customer fails to comply to the previous procedures, NLP can’t be held responsible for any additional charge from Telepass or failure to use the Reservation Service.

5. Entry and exit times

5.1. Entry to the car park can be made 60 (sixty) minutes before the entry time indicated in the Reservation Confirmation. Exit from the car park must be done no later than 60 (sixty) minutes after the exit time specified in the Reservation Confirmation. The Customer is therefore granted a one hour tolerance regarding the times specified in the Reservation Confirmation, without additional payments or further charges.

5.2. Unless otherwise agreed with NLP in written form, entry is allowed only once, therefore the exit of the vehicle from the car park puts an end to the Service.

5.3. It is implied that no refund, compensation or free extension is due to the Customer if, for any reason not imputable to NLP, the stay in the car park is shorter than the duration agreed in the Reservation Confirmation.

5.4. Exception made for what is stated at the previous article 5.1, if the Customer extends the stay, for any reason or cause, beyond the duration agreed in the Reservation Confirmation, the additional cost (hereinafter “Additional Fee”) will be calculated according to the “standard fees” that apply in the selected car park and in force at the time of entry.

5.4.1. In case of Reservation with online advance payment, the Customer authorizes NLP to automatically charge the Additional Fee to the same payment method used for the Reservation payment.

5.4.2. In case of Reservation with payment on site, the Customer must pay the Additional Fee at the automatic cash machines or at the manned cash office, before leaving the car park.

6. Change/Cancellation of a Reservation

6.1. Any change or cancellation of the Reservation must be done through the reserved area on the Website not later than 24 (twenty-four) hours before the entry time indicated in the Reservation Confirmation (hereinafter the “Deadline”).

6.2. Subject to availability, changes to the duration of the stay and/or selected car park may lead to a change in the final price, based on the fee applied in the selected car park and/or the fee in force at the time of the change and/or the different stay duration.

6.3. In case of cancellation before the Deadline, the Customer will be refunded the full price paid, excluding any commissions, within 14 (fourteen) days from the cancellation notice, on the same payment method used for the initial transaction. If the cancellation is done after the Deadline the Customer can not be entitled to any refund or compensation.

6.4. In case of missing cancellation, the Customer that does not use the Service, for any reason or cause, is not entitled to any refund or compensation, with NLP’s consequent right to collect (in case of Reservation with payment on site) or withhold (in case of Reservation with online advance payment) the entire amount specified in the Reservation Confirmation.

7. Additional services

7.1. Any additional service, if available, can be requested before the Reservation Confirmation. The specific terms and conditions that apply are established when purchasing said services during the Reservation process and in the Reservation Confirmation for the specific additional services requested.

7.2. It is implied that NLP does not assume any responsibility or obligation for services performed by third parties, which will be regulated by the specific service provider’s terms and conditions.

9. Applicable law and Jurisdiction

9.1. These General Conditions are governed by the Italian law.

9.2. If the Customer is a consumer pursuant to and for the purposes of the Consumer Code (D. Lgs. 206/2006 s.m.i), for any dispute regarding the interpretation, application or execution of this contract the Court of the city where the Customer resides or has domicile will be competent. In all other cases the Court of Venice will have exclusive jurisdiction.
